In a series of decisions this week, the United States Supreme Court sent a message that it was alive and equal to the executive branch. This surely came as a disappointment to the Bush administration which has wanted to run America in secret and have us just trust it.

The first big decision of the week was the grandstander. In it the Court ruled 8-1 that detainees in Bush's war on terror had the right to a hearing and legal counsel on the issue of their status designation. Surprise. The Court rediscovered due process in this case. Only Clarence Thomas -- perhaps still not awake then -- dissented in favor of Bush.

Hurray! The modern version of McCarthyism has been broken in the courts. 06.30.04
